Agreed to commission but paid on collection

Hi. I worked at an office for a year and a half. I left yesterday because I’ve argued with them for over a year. I agreed to commission on production. When insurance checks come in and they have entered an incorrect fee schedule or whatever, they write these off on my production. When I argue it they say “Why should we pay on incorrect billing?” And I argue “Why should I be penalized for incorrect billing??” Is there any legal action I can take to get this money?

First and foremost, I applaud you for standing up for yourself and not allowing yourself to be taken advantage of. Commission based on production is far different than commission based on collections! Further, if a certain pay structure is agreed upon, that’s how you should be paid.
 
Whether there’s legal action you can take might be best discussed with a lawyer that specializes in employment matters. Not being a lawyer myself, it’s hard to give a definitive answer. There might also be the option of small claims court, but again, I feel it would be best to consult with a lawyer to weigh your options.
